Action in the Sibley County District Court for personal injuries allegedly sustained by plaintiff as a passenger in an automobile owned by defendant Rufina Henke and driven by defendant Roger Henke when it collided with a vehicle owned by defendant Willard Deitz and driven by defendant Donald Berg, which vehicle had allegedly been leased to defendant Green Giant Company. Cross-claims were filed by defendants. The case was tried before Arlo E. Haering, Judge, and a jury, which found in a special verdict that both drivers were negligent but that the negligence of Henke was not a direct cause of the accident. Defendants Deitz, Berg, and Green Giant Company appealed from the judgment entered against them in favor of plaintiff and defendants Henke.
